OFFICIAL RULES
NO PURCHASE NECESARRY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
TIMING: The Sweepstakes begins on August 3, 2012 and ends on August 5, 2012.
ELIGIBILITY: The Pocono Raceway “Pennsylvania 400 Pocono Presidential Pick for $100,000” Sweepstakes (the “Sweepstakes”) is open only to legal residents of the United States, the District of Columbia (excluding NY and FL) who are sixteen (16) years of age or older at the time of entry. Employees, shareholders, directors, officers, members, successors and agents of the Sponsor, its affiliates, retailers, advertising & promotion agencies, as well as any other entity, or individual, directly associated with this promotion, and the immediate family members (spouse, parents, siblings and children) and/or household members of these entities, are not eligible to participate. All federal, state/provincial and local laws and regulations apply.
HOW TO ENTER: Visit one of the official Pocono Raceway Souvenir Stands located throughout the Pocono Raceway facility, during their normal operating times between 6:00 AM Eastern Time (“ET”) and the close of track activities on 08/03/12 and 08/04/12 between 6:00 AM ET and 12:00 PM ET on 08/05/12, complete an entry form in its entirety, and submit as directed.
Limit: One (1) entry per person during the Promotion Period. Any additional entries by an individual will be void.
Entries become property of the Sponsor and will not be returned. Automated entries are prohibited, and any use of such automated devices will cause disqualification. Sponsor and its advertising and promotions agencies are not responsible for lost, late, illegible, misdirected or stolen entries or transmissions, or problems of any kind whether mechanical, human or electronic.
PRIZES/APPROXIMATE RETAIL VALUE (“ARV”): Grand Prize: There is one (1) Grand Prize available to be won of $100,000. ARV of Grand Prize: $100,000.
First Prizes: There are five (5) First Prizes available to be won of a pair of Terrace Club Seats for a 2013 NASCAR Sprint Cup Series race at Pocono Raceway. ARV of First Prize: $500 each.
Maximum Approximate Retail Value of Grand Prize: $102,500.
ODDS: Odds of winning a First Prize will depend on the number of eligible entries received. Odds of a First Prize winner being named the Finalist are 1:5.
WINNER SELECTION & PRIZE DETERMINATION: On or around the 80th lap of the 2012 Pennsylvania 400 on August 5, 2012 (the “Race”), Sponsor will select five (5) First Prize winners in a random drawing conducted by the Sponsor from among all eligible entries received during the Promotion Period. Immediately following the determination of the First Prize winners, Sponsor will conduct a random drawing from among the selected First Prize winners to determine the potential Grand Prize winner (the “Finalist”). The potential Grand Prize winner will be notified by telephone and/or on the Sprint Vision Screen immediately following the drawing If Dale Earnhardt Jr. (or the driver of the #88 car in the event Dale Earnhardt Jr. cannot start the Race) wins the Race, the Finalist winner will win the Grand Prize. If any other driver wins the Race, the Grand Prize will not be awarded. If the Finalist is present at the race, Sponsor may request the Finalist attend an event prior/during the end of the Race to watch the end of and see who wins the Race.
Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry processes or the operation of the Promotion; to be acting in violation of these Official Rules; to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion; or is found to be intoxicated or engaging in behavior that (as determined by Sponsor in Sponsor’s sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person or deemed by the Sponsor to be threatening or damaging to the Sponsor.
PRIZE CONDITIONS: No substitution or transfer of any portion of a prize permitted, except that the Sponsor reserves the right to substitute a prize of equal or greater value in the event that a prize is unavailable. There is no cash substitute for a First Prize. All federal, state, or other tax liabilities, if applicable, are the sole responsibility of the winner. Grand Prize winner will be required to provide their Social Security Number for tax reporting purposes. An IRS Form 1109-MISC will be issued to the Grand Prize winner for the Retail Value of the prizes received for the 2012 tax year.
WINNER NOTIFICATION: In the event the Finalist wins the Grand Prize, the Finalist will be required to sign an Affidavit of Eligibility, a Liability Release, and, except where prohibited by law, a Publicity Release (the “Affidavit”), within five (5) days of the Race. Failure to return these documents within the required time period may result in disqualification and selection of an alternate Grand Prize winner from among the remaining First Prize winners. If any winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner’s parent or legal guardian who will be required to execute and return the Affidavit on minor’s behalf, if and as required. Grand Prize will be awarded once the Affidavit has been completed, returned and the winner’s eligibility verified by Sponsor. First Prizes will be awarded within 4-6 weeks from the date of the Race to the address provided at entry
LIMITATION AGAINST LIABILITY: Winner agrees that (except where prohibited) Sponsor may use winner’s name, picture, portrait, likeness and voice for advertising and promotional purposes without further compensation. Sponsor, its promotional and advertising agencies, its affiliates and subsidiaries, and each of their respective officers, directors, employees, representatives, members, successors, assigns (collectively, the “Released Parties”) and agents shall have no liability and shall be held harmless by winner for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in this Sweepstakes. Any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney’s fees. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Sweepstakes should virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Sweepstakes. In such event, Sponsor may award the prizes in a random drawing from all eligible entries received up to the date of cancellation or suspension. Sponsor and the Released Parties are not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the promotion. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor’s representatives. Subject to federal, state/provincial, and local laws.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE
SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM
ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING
CRIMINAL PROSECUTION.
DIRECT MARKETING: By entering the Promotion, Entrants acknowledge that the Sponsor collects personal information about users when registering for the Sweepstakes. All opt-in subscribers may receive various marketing or other information from the Sponsor regarding their products or services. Entrant may discontinue receiving the promotional emails at any time by unsubscribing from the link in the email.
