"FAN-TASTIC OFFER" Sweepstakes
OFFICIAL RULES
NO PURCHASE NECESSARY
1. ELIGIBILITY: The "FAN-TASTIC OFFER" Sweepstakes (the "Sweepstakes") is open only to legal residents of the fifty United States (including D.C.) and Canada (excluding Quebec, where it is Void), who are 18 years of age or older at the time of entry, and are current ticket holders for the 2007 Pocono Raceway season. Employees and Directors of Pocono Raceway, Inc. (the "Sponsor"), their affiliates, licensees or agents, their advertising and promotion companies, the immediate family members of these entities, and those living in the same household of each, are not eligible to participate. All applicable federal, state, and local laws and regulations apply. Void where prohibited.
2. SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:01 AM Eastern Time ("ET") on September 16, 2007 and ends at 11:59 PM ET on November 1, 2007 (the "Sweepstakes Period").
3. HOW TO ENTER: There are two methods of entry. 1) Renew your tickets for the 2008 Pocono Raceway season and you will be automatically entered into the Sweepstakes. 2) Send a postcard including your name, address, city, state, zip code, and a phone number where you can be reached during the day to: Pocono Raceway "FAN-TASTIC OFFER" Sweepstakes, 625 Panorama Trail, Bldg. 2 Suite 100, Rochester, NY 14625 (Canadian residents: Please mail above to: Pocono Raceway "FAN-TASTIC OFFER" Sweepstakes, 17-7000 McLeod Road, Unit 135, Niagara Falls, ON L2G 7K3). Mailed entries must be postmarked by November 1, 2007 and received by November 7, 2007. All entries become the property of the Sponsor, and will not be returned.
LIMIT: Each Entrant may only submit one entry during the Sweepstakes Period, regardless of means of entry. Multiple participants are not permitted to share the same email address. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, or any other methods will void that EntrantÕs entries and that Entrant may be disqualified.
4. DRAWING/NOTIFICATION: Winners will be selected in a random drawing on or around November 30, 2007 by the Independent Sweepstakes Administrator from among all eligible entries received during the Sweepstakes Period. Each winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (where allowable) within seven (7) days from the date of the notification. Guest of winner must complete a Companion Liability/Publicity Release before prize arrangements will be made. Failure to return such documentation within the required timeframe may result in selected winner being disqualified and the selection of another winner. Winner must comply with all Sweepstakes rules. Failure to comply with these requirements for any reason, return of prize notification or prize as undeliverable, or if a winner is disqualified for any reason will result in forfeiture of prize and an alternate winner will be selected from the remaining eligible entries. Acceptance of any prize shall constitute and signify the winner's agreement and consent that Sponsor may use the winner's name, city, state, likeness, photos, and/or prize information in connection with the Sweepstakes worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law.
5. PRIZES: Twenty (20) Grand Prizes will be awarded consisting of a ride in a PA National Guard Humvee as they escort the NASCAR Sprint Cup Series ("NSCS") Drivers at Pocono Raceway and a NSCS Garage Tour for themselves and a guest. Ten (10) Grand Prize winners will participate in the escort ride and receive a NSCS garage Tour for the June 8, 2008 Pocono 500, and ten (10) Grand Prize winners will participate in the escort ride and receive the NSCS Garage Tour for the August 3, 2008 Pennsylvania 500. There is no cash or retail value to the Grand Prize. Prizes are non-transferable; no substitutions or exchanges except at the sole discretion of the Sponsor, who also retain the right to substitute a prize of equal or greater value. All other expenses not expressly listed herein, are the sole responsibility of the winner to pay, including, but not limited to, meals, and transportation to/from the event. Prize must be taken on date as determined by Sponsor in winner notification. If winner is unable to travel on specified dates, prize will be forfeit and an alternate winner may be selected.
6. GENERAL RULES: By entering or participating in the Sweepstakes, entrants agree to be bound by these Official Rules. Sponsor assumes no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any entry or other information, or for the failure to capture any such information. Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) for illegible, damaged, lost, late, misdirected, or postage-due mailed entries. If, for any reason, the Sweepstakes is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, at their sole discretion, to cancel, terminate, modify or suspend the Sweepstakes, and select the winner for the Sweepstakes, from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by Sponsor. Entrants, by participating in this Sweepstakes, hereby waive and release, and agree to hold harmless the Sponsor, the Independent Sweepstakes Administrator, all promotions and advertising agencies, and their respective parents, subsidiaries, affiliates, distributors, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of the prize in the Sweepstakes, or their participation in the Sweepstakes, or their participation in any Sweepstakes or prize related activity, or any travel related to the Sweepstakes or any travel for any prize related activity. Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved under the laws of the State of Pennsylvania, without respect to any conflict of law issues, and entrant agrees that such shall be resolved individually, without resort to any form of class action.
7. SWEEPSTAKES RULES/WINNER CONFIRMATION: To obtain a copy of the Official Sweepstakes Rules or to request the name, city and state of the prizewinners, send a self-addressed stamped envelope to: Pocono Raceway "FAN-TASTIC OFFER" Sweepstakes, PO Box 25497, Rochester, NY 14625. Indicate "Official Rules Request" or "Winner Confirmation" on the front of the envelope. Requests for Official Rules and/or winner list must be postmarked by December 31, 2007.
